  2. EASEMENT AGREEMENT

  5. Hilda Householder, referred to as OWNER, and Swell Telephones, 
  6. Inc., referred to as GRANTEE, agree:

  9. OWNER is the owner in fee simple of the following described real 
  10. estate:

  17. In consideration of $ 5,000.00 ( five thousand & no/100 dollars) 
  18. paid by GRANTEE, the OWNER grants to GRANTEE an easement to place 
  19. utility poles and lines for the transmission of electricity over 
  20. the following portion of the above-described premises:

  23. that property within 40 feet of Highway 217, and all the airspace 
  24. above it
  25.  
  26.  
  27. The GRANTEE shall have the right to ingress and egress for the 
  28. purpose of maintaining said electrical poles and lines, and 
  29. further, shall have the right to prune any tree limbs or other 
  30. vegetation which may cross into the plane of the easement.

  33. GRANTEE shall indemnify and hold OWNER harmless as to all claims 
  34. related to or arising from the electrical facilities or use of 
  35. the easement and shall further promptly pay OWNER for any damages 
  36. suffered by OWNER due to its activities.

  39. The grant of easement herein shall bind the heirs and assigns of 
  40. the OWNER and GRANTEE. The rights herein shall be specifically 
  41. enforceable.
